The 56th Wumei Family Law Salon | Seminar on Hot Issues of Criminal-Civil Overlap in Marital and Family Law Practice Successfully Held

On November 20, 2025, the 56th session of the Wumei Family Law Salon, themed Hot Issues of Criminal-Civil Overlap in Marital and Family Law Practice, was successfully hosted by Guangdong Wumei Law Firm.

The seminar specially invited senior lawyers specializing in criminal law, civil enforcement and marital and family law as guest speakers: Lawyer Peng Xin, Executive Director of Guangdong Fanachuandqiong Law Firm; Lawyer Huang Yiwei, Senior Partner of Guangdong Guozhi Law Firm; Lawyer Wang Pingze, Senior Partner of Beijing Jincheng Tongda (Guangzhou) Law Firm; and Lawyer Lu Junfeng, Partner of Guangdong Wumei Law Firm. The event was moderated by Lawyer Guan Hongmin of Guangdong Wumei Law Firm.

 

The in-depth discussion focused on four core topics: the disposition of crime-related property and the protection of the legitimate rights and interests of family members of persons subject to enforcement; the distinction between guilt and innocence in family disputes; criminal accusation strategies in marital and family-related disputes; and the construction of criminal compliance for family enterprises amid marital relations.

The guest speakers focused on typical difficulties arising from the criminal-civil overlap in family law matters, and thoroughly analyzed legal risks and response strategies in various practical scenarios. The discussion covered the practical determination of guilt and innocence, including whether privacy coercion during divorce proceedings constitutes extortion, and whether fabricating debts amounts to false litigation.

In terms of the disposal of property involved in criminal cases, they elaborated on approaches to protecting spouses’ lawful property rights and interests, risk prevention and control when personal property is subject to enforcement, and the enforcement priority between child support and illegal gains.

 

 

Drawing on rich practical experience, the speakers shared techniques to improve the filing success rate of bigamy cases and the procedural guidelines for filing criminal accusations against the embezzlement of a decedent’s estate. They also analyzed typical illegal acts likely to occur in the joint operation of family enterprises, such as misappropriation of funds and occupational embezzlement.

By illustrating the vital role of marital property agreements in risk isolation, the seminar helped establish a criminal risk early warning system for entrepreneurs undergoing marital changes. It provided systematic and multi-dimensional guidance for lawyers in case handling and compliance risk prevention, and enhanced their overall understanding and practical capability in dealing with criminal-civil overlap issues in the field of marital and family law.

 

 

The interactive session was lively and engaging, with lawyers speaking actively and exchanging views enthusiastically. Many lawyers shared their practical experience and sought professional advice on disputed issues and operational difficulties encountered in daily practice. Others offered their reflections and unique insights on operational challenges and legal basis mentioned in the lecture.
The exchange enabled participants to further recognize the necessity of strengthening criminal compliance awareness and strategic application in family cases, and opened up new ideas and solutions for handling similar matters in the future.
